The App

Shift Culture LLC ("Shift Culture," "we," "us") provides a free mobile app that surfaces Shift Culture giveaways, events, content, and community posts. The app is a companion to the websites at shiftcultureofficial.com and shiftculturegiveaway.com.

The app does not sell sweepstakes entries, event tickets, merchandise, or services. All paid actions are completed on the relevant Shift Culture website via the in-app "View on web" links.

Eligibility

You must be 17 or older to use the app (or the age of majority in your jurisdiction, if higher). By creating an account, you represent that you meet this age requirement. We may terminate accounts that don't.

Your account

You sign in via SMS one-time code or, on iOS, Sign in with Apple. You're responsible for keeping your phone and device secure. One account per person. Don't impersonate someone else or hold multiple accounts to game contests. We may suspend or terminate accounts that violate these Terms, especially in connection with sweepstakes.

Sweepstakes

Sweepstakes shown in the app are operated at shiftculturegiveaway.com under that site's Official Rules. The app is informational only.

No purchase necessary. Each sweepstakes provides a free Alternative Means of Entry described in the Official Rules. Void where prohibited. Apple, Google, and Shift Culture LLC are not sponsors of any individual sweepstakes; each sweepstakes identifies its sponsor in its Official Rules.

Community content

By posting in the community feed you agree not to post content that is unlawful, harassing, threatening, hateful, sexually explicit, infringing, malicious, or otherwise objectionable. You retain rights to content you post; you grant Shift Culture a worldwide, non-exclusive license to display, distribute, and promote that content within the app. We reserve the right to remove any content or suspend any account at our discretion.

The app supports Reporting and Blocking. We commit to reviewing reported content within 24 hours and acting on confirmed violations. Posts containing illegal, harassing, or otherwise prohibited content are removed; repeat violators are banned.

Acceptable use

Don't reverse-engineer or scrape the app at scale. Don't use the app to harass, threaten, defame, or impersonate. Don't submit content that infringes copyright, contains malware, or violates the law. Don't attempt to bypass security, rate limits, or sweepstakes eligibility checks.

Intellectual property

The Shift Culture app, brand, logos, and original content are owned by Shift Culture LLC. You receive a personal, non-exclusive, revocable license to use the app for non-commercial purposes.

Third-party content

Embedded YouTube, TikTok, and Instagram content is governed by those platforms' own terms. Linked external sites — including Shift Culture's own websites — are governed by their respective terms.

Disclaimers

The app is provided "as is" without warranties of any kind. Sweepstakes outcomes, prize delivery, and event details are governed by the relevant Official Rules and event organizer disclosures, not these Terms.

Limitation of liability

To the fullest extent permitted by law, Shift Culture's total liability for any claim arising out of the app is limited to $50 or the amount you've paid us for app use in the prior 12 months (which is normally $0, since the app is free), whichever is greater. We are not liable for indirect, incidental, or consequential damages.

This limitation does not apply to liabilities that cannot be excluded by law (e.g., gross negligence or fraud).

Termination

You can stop using the app at any time and delete your account from Profile → Account → Delete account. We can terminate accounts that violate these Terms. Provisions that by their nature should survive termination (intellectual property, disclaimers, liability, governing law) survive.

Governing law

These Terms are governed by the laws of the State of Florida, without regard to conflict-of-laws rules. Disputes are resolved in the state or federal courts located in St. Lucie County, Florida.

Apple addendum

These Terms serve as the End User License Agreement between you and Shift Culture LLC for use of the app on Apple devices. Apple is not a party. Shift Culture LLC — not Apple — is responsible for any maintenance, support, or product-liability claims related to the app. If the app fails to conform to any applicable warranty, you may notify Apple; to the maximum extent permitted by law, Apple has no other warranty obligation. Apple and its subsidiaries are third-party beneficiaries of these Terms with the right to enforce them against you.

Changes

We may update these Terms. Material changes will be announced in-app on next launch. Continued use after the effective date constitutes acceptance.
